This concept, also referred to as “ties with Portugal” or “connections with Portugal,” is widely applied in immigration and citizenship laws, especially in nationality acquisition processes.

When is it necessary to prove an effective connection to the Portuguese community?

Proof of effective connection to the Portuguese community is required in citizenship application processes, particularly for:

• Grandchildren of Portuguese nationals
• Spouses or partners of Portuguese nationals
• Descendants of Sephardic Jews

Currently, the legislation provides certain presumptions of connection to facilitate this proof in some cases, which we will explain in detail.

Connection to Portugal for Brazilians

Currently, demonstrating ties to Portugal is simpler for citizens of the Community of Portuguese-Speaking Countries (CPLP), which includes Brazilians. The Portuguese government automatically presumes that these individuals have knowledge of the Portuguese language, waiving the need for additional documentation, creating an automatic tie.

How to prove ties with the Portuguese community

Portuguese legislation does not specify detailed criteria for proving ties to the Portuguese community, making the evaluation somewhat discretionary. However, based on our daily experience, here are some examples that are typically accepted:

• Living legally in Portugal
• Demonstrating frequent travel to Portugal
• Owning property or renting an apartment in Portugal for more than three years
• Having ties with a Portuguese community abroad, such as a cultural association or Portuguese club in the country of residence
• Presenting a certificate demonstrating knowledge of the Portuguese language

Other forms of proof may vary depending on the specific type of citizenship requested, which we will address in more detail below.

Ties to the Portuguese Community for Grandchildren

For Portuguese citizenship by grandchildren, proof of knowledge of the Portuguese language is required for the application to be approved. Again, for applicants from countries where Portuguese is the official language, this link is automatically presumed, eliminating the need for additional proof.

Effective Connection to the Portuguese Community for Spouses

For those married to or in a stable union with a Portuguese citizen for at least six years, proof of connection is automatic.

However, if the union has lasted more than three but less than six years, it is still possible to apply for Portuguese citizenship by marriage, provided one of the connections above is demonstrated or if the couple has a child who already holds Portuguese citizenship. In this case, knowledge of the Portuguese language is also required.

Bonds to the Portuguese Community for Sephardic Jews

In applications for Portuguese citizenship by descendants of Sephardic Jews, in addition to presenting the certificate issued by the CIL (Portuguese Jewish Community), it is necessary to demonstrate the following ties with Portugal under the current law:

• Ownership of inherited property in Portugal, other personal rights to enjoyment, or participation in Portuguese companies
• Proof of regular travel to Portugal throughout life, demonstrating an effective and enduring connection to the country

Evaluating the Effective Connection to the Portuguese Community

But how can you know if the ties presented in the Portuguese nationality application are sufficient for approval?

In practice, the answer is only known with the application result, which can take between 24 and 29 months to process, depending on one of three possible cases. The assessment is conducted by the Conservatória dos Registos Centrais, which can approve the connection to Portugal through automatic verification or a detailed document review.
