This means that Portuguese citizens, including foreigners with dual citizenship, now have a new type of visa to live in the United States. We are talking about the American E2 Visa, the Entrepreneur Visa.
With the treaty, about 400 thousand Brazilians with Portuguese citizenship will be able to apply for an E2 visa to live in the USA. To request the visa, it is necessary to have a reasonable amount of money to invest in the country. Although no minimum investment amount is stipulated, an amount of at least 100 thousand dollars is recommended to open the business, which should also generate jobs.

The E2 visa is aimed at those who intend to become entrepreneurs in the USA, either through their own business or a franchise. It does not allow the bearer to work in another company, only where he has his investments. The investment must be active, create jobs, and be made with own funds.
The visa authorizes the owner to live legally in the United States for as long as he/she follows the business plan presented for immigration, with the generation of jobs, income and payment of taxes. In addition, the investor must be fully dedicated to the business, be the principal investor or an employee in a supervisory, executive, or highly specialized capacity. Unqualified employers are not eligible.

E2 is only granted only to nationals of countries with investment treaties with the USA. Currently, about 90 countries have this agreement, including Portugal. Brazil is not on the list.
The E2 visa is extendable to family members of the applicant, but does not allow formal employment of family members. In addition, benefited children, upon turning 18 years old in the United States, need a visa renewal to remain in the U.S. territory.
